1. About these terms

These terms and conditions explain the rules for using the website spencerandjackson.com (our “website”) and, in section 5, the terms that apply to guests staying at the properties we manage. By using our website or staying at one of our properties, you agree to these terms. If you do not agree with them, please do not use our website.

2. Who we are

This website is operated by Spencer and Jackson Property Group (“we”, “us”, “our”), a short-let property management company based in Bedford, England, registered in England and Wales under company number 14783354.

You can contact us by email at enquiries@spencerandjackson.com or by phone on 0203 947 9747.

3. Using our website

You may use our website for your own personal or business purposes, such as finding out about our properties and services, making an enquiry, or finding out about our property management service. You must not:

  • use our website in any way that is unlawful or fraudulent;
  • try to gain unauthorised access to our website, the server it is stored on, or any connected systems;
  • introduce viruses or other harmful material to our website; or
  • copy, scrape or reuse content from our website for commercial purposes without our written permission.

We aim to keep our website available at all times, but we do not guarantee that it will always be available or free from interruption, and we may suspend or change it without notice.

4. Information on our website

We take care to make sure the information on our website, including property descriptions, photographs, amenities and locations, is accurate and up to date. However, details can change, and photographs are for illustration only. The information on our website is for general information and does not form part of any contract unless we confirm it in writing.

5. Guest bookings and stays

5.1 Bookings

Submitting an enquiry through our website does not create a booking or a contract. A booking is confirmed only once you have received a written booking confirmation from us or from the booking platform you used. Every booking is also subject to any booking terms shown at the time of booking. If those terms conflict with these terms, the booking terms will apply to your stay.

5.2 Pre-arrival verification

All guests must complete our pre-arrival verification before check-in. We use Safeguest, a third-party guest verification and deposit handling service, to manage this on our behalf. After booking, you will receive a secure link from Safeguest, which can be completed on a mobile phone in a few minutes. As part of this process, you will be asked to:

  • verify your identity using valid photo identification and a biometric check;
  • read and agree to our house rules and sign our rental agreement; and
  • choose your security deposit option (see section 5.3).

Access details for the property will only be provided once verification is complete. We may decline or cancel a booking if verification is not completed before arrival. Information about how Safeguest handles your personal data is set out in its Privacy Notice.

5.3 Security deposits

Security deposits are handled on our behalf by Safeguest. During pre-arrival verification, you will be asked to choose one of the following options:

  • Damage Deposit: a refundable deposit of £150, collected before arrival and refunded after check-out once the property has been inspected and confirmed to be free from damage. The time it takes for a refund to appear in your account depends on your card provider.
  • No Deposit Option: a non-refundable No Deposit Fee (also known as a damage waiver), paid instead of a Damage Deposit. The amount of this fee will be shown to you during the verification process.

Choosing the No Deposit Option does not remove your responsibility for any damage caused during your stay.

Whichever option you choose, if damage, missing items or additional cleaning are identified after check-out, or these terms are breached, Safeguest will manage any deduction, recovery, dispute and refund on our behalf, up to the applicable deposit limit. Supporting evidence will be provided in every case.

Receipts: If you choose the No Deposit Option, the No Deposit Fee is paid to, received and retained by Safeguest, not by Spencer and Jackson Property Group. Any receipt for this payment must therefore be obtained directly from Safeguest.

5.4 Check-in and check-out

Check-in is from 4:00 pm and check-out is by 11:00 am, unless otherwise stated in your booking confirmation, as times may vary between properties.

5.5 House rules

To ensure the comfort and safety of all guests and neighbours, the following rules apply at all our properties:

  • Only guests named on the confirmed reservation may stay at or visit the property.
  • Smoking and vaping of any kind is strictly prohibited inside the property. This includes tobacco, cannabis, cigars, electronic cigarettes and any similar product that produces smoke or vapour.
  • Parties, events and gatherings are strictly prohibited.
  • Quiet hours are between 9:00 pm and 9:00 am. During this time we ask that you keep noise to a minimum out of respect for our neighbours.

A breach of these house rules may result in your stay being ended early without a refund, and you may be charged for any resulting costs in line with section 5.3.

5.6 Security and monitoring devices

For security and verification purposes, an external security camera is installed at the property, covering the exterior only. A Minut device is also installed inside the property. This device monitors noise levels and detects smoke; it does not record audio or video. Tampering with, removing or obstructing the camera or the Minut device is strictly prohibited.

5.7 Cancellation policy

Once payment for your reservation has been made, you may cancel free of charge up to 7 days before your arrival date. If you cancel within 7 days of arrival, or do not arrive for your stay, the full price of the reservation will be charged.

6. Landlord and property owner enquiries

Information on our website about our property management service, including any examples or estimates of potential earnings, is provided for general guidance only. Earnings depend on many factors, including location, property type, demand, season and market conditions, and are not guaranteed.

Submitting an enquiry through our Partner With Us form does not create any obligation for you or for us. Our property management service is only provided under a separate written management agreement signed by both parties, and the terms of that agreement will apply to the service.

7. Intellectual property

We own, or have permission to use, all content on our website, including text, photographs, logos and design. You may view and print pages for your own use, but you must not copy, reproduce or distribute our content for any other purpose without our written permission.

8. Links to other websites

Our website may contain links to other websites, such as booking platforms, maps or social media. These links are provided for your convenience only. We have no control over the content of those websites and are not responsible for them or for any loss that may arise from your use of them.

9. Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales. If you are a consumer, these terms do not affect your legal rights.

Subject to the paragraph above, we will not be liable for any loss or damage arising from your use of, or inability to use, our website, or from relying on any content on it. We are not responsible for any loss or damage caused by a virus or other harmful material that may affect your device, data or other material as a result of your use of our website.

10. Your personal information

We will only use your personal information as set out in our Privacy Policy.

11. Changes to these terms

We may update these terms from time to time. The date at the top of this page shows when they were last updated. Please check this page whenever you use our website, as the latest version will apply.

12. Governing law

These terms are governed by the law of England and Wales. Any dispute relating to them will be dealt with by the courts of England and Wales, although if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.

13. Contact us

If you have any questions about these terms, please contact us at enquiries@spencerandjackson.com or call 0203 947 9747.
